Just Play Game Jam for Climate Futures 2024: Terms and Conditions
ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY, AS APPLICABLE. VOID WHERE PROHIBITED. UNLESS YOU AGREE TO THESE RULES, YOU (1) MUST NOT PARTICIPATE IN THE CONTEST AND (2) ARE NOT ELIGIBLE TO RECEIVE AWARDS UNDER THE CONTEST
1. Eligibility. Just Play Game Jam (the “Contest”) is open to individuals who are at least eighteen (18) years old at the time of entry. Employees, Officers, Directors, and Contractors of Cinereach Ltd. or Anima Interactive, LLC and their respective immediate families (spouse, parents, siblings, and children) and household members of each such individual are not eligible. This Contest is organized by Cinereach Ltd. (“Cinereach”) in consultation with Anima Interactive, LLC (“Anima”), and all awards for the Contest shall be provided by Cinereach.
Participation in the Contest constitutes the entrant’s full and unconditional agreement to these terms and conditions and Cinereach and Anima’s decisions, which are final and binding in all matters related to the Contest. Winning an award is contingent upon the entrant fulfilling all requirements set forth herein and adherence to the Contest’s rules.
2. Sponsor. Cinereach Ltd. is a tax-exempt 501(c)(3) organization duly organized in the State of Delaware and with a mailing address of 240 Kent Avenue, Brooklyn, NY 11249.
3. Contest Period. Registration for the Contest opens on April 29, 2024 and shall remain open through May 17, 2024, at 11:59pm ET. The Contest will start on April 29, 2024, and end on May 17, 2024, at 11:59pm ET. Entries that are submitted after this date and time will be disqualified. The finalists of the Contest are expected to be announced some time after May 28, 2024, and the finalists will be presented and the grand prize winner will be announced at the Hollywood Climate Summit Closing Night Party currently scheduled for June 28, 2024.
4. How to enter. In order to be considered for the Contest, entrants must register here and submit a game (adhering to all themes and stated requirements within the Contest’s rules) by no later than May 17, 2024, at 11:59pm ET. Limit one (1) entry per person/group, regardless of method of entry. Entries received from any person/group in excess of the stated limitation will be void. Cinereach reserves the right to change or omit entrant group names, particularly if they are, in Cinereach’s sole discretion, offensive or obscene or violate the intellectual property of others.
5. Winner selection. All eligible submissions shall be evaluated by a panel of judges selected jointly by Cinereach and Anima and, in such panel’s sole discretion, shall determine finalists, depending on the quality of submissions.
6. Awards. Cinereach shall feature finalist prototypes at the Hollywood Climate Summit Closing Night Party currently scheduled for June 28, 2024 in Los Angeles, with the grand prize winner to be announced at the reception. Certain of the selected finalists, at Cinereach’s sole discretion, may be invited to participate in workshops with a paid honorarium held by Cinereach during the July 1, 2024 – June 30, 2025, fiscal year with an opportunity for certain workshop participants to qualify for further potential development investment for their game prototype to be determined at Cinereach’s sole discretion at the conclusion of the workshop.
To receive further financing, each workshop participant must complete and execute applicable documentation provided by Cinereach, including, but not limited to, relevant tax forms and funds usage agreements. Be advised that funds usage agreements provided to the workshop participants selected for further development investment, if any, shall contain restrictions on how financing provided must be utilized and additional requirements regarding the further development of the game, amongst other terms.
Out of the finalist pool, there will be one grand prize winner selected to receive a $10,000 USD cash prize, which will be paid in two installments, $5,000 at the awards ceremony and $5,000 after the completion by the winner of the workshop process which will occur sometime during the fiscal year 2025.
7. Release of Liability. By registering for the Contest, the registrant agrees to release and hold harmless Cinereach, Anima, and their subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and their officers, directors, employees and agents, and the individuals serving as judges for the contests, and their respective companies of employ, and the officers, directors, employees, and agents thereof (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to personal injury, death, or damage to or loss of property arising out of participation in the Contest or receipt, use, or misuse of the award or any component thereof.
8. Publicity Release. Except where prohibited, participation in the Contest constitutes an entrant’s consent for Cinereach to utilize their name, likeness, image, photograph, voice, opinions, and/or hometown, State, and/or County for the furtherance of the Contest and for promotional purposes in any media worldwide, without further payment or consideration. Participation in the Contest also constitutes consent by the participant, if selected as a finalist, for Cinereach to display and demonstrate the participant’s prototype submissions, with credit to the participant, during the Hollywood Climate Summit 2024 and/or any private preview in association with the Just Play game jams.
9. General Conditions. Cinereach reserves the right to cancel, suspend, and/or modify the Contest, or any part of it, if any fraud, technical failures, or any other factor beyond Cinereach’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Cinereach in its sole discretion. Cinereach reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these terms and conditions or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and should such an attempt be made, Cinereach reserves the right to seek damages from any such person to the fullest extent permitted by law. Cinereach’s failure to enforce any term of these terms and conditions shall not constitute a waiver of that provision.
10. Limitations of Liability. The Released Parties are not responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing, or transcription errors or by any of the equipment, platforms, or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of Entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Contest or receipt, use, or misuse of further financing, if any, or any component thereof.
11. Disputes. By participating, entrants agree that (1) any and all disputes, claims, and causes of action arising out of, or connected with, this Contest, the award or further financing (if applicable) shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the county of New York, New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including but not limited to costs associated with entering this Contest, but in no event attorneys’ fees; and (3) to the extent allowed by applicable law, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and/or consequential damages and/or any damages other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
12. Governing Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions or the rights and obligations of any participant, Cinereach or Anima in connection with the Contest shall be governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws.
13. Severability. The invalidity or unenforceability of any provision of these terms and conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these terms and conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
14. Discrepancies. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest-related materials, notifications, or announcements and these terms and conditions, these terms and conditions shall prevail, govern and control.
